Real Estate Lawyers in Spain When buying a property in Spain for the first time it is recommended to take on the services of a lawyer, (abogado). Issues such as land registry, property ownership and outstanding payments on the property are some of the checks that real estate lawyers make in Spain on your behalf as well as obtaining nie number, which is required to register the property in your name. If you are unable to be present for the completion of the purchase you can appoint power of attorney to your lawyer. If you are able to come to Spain for the completion of the escritura or title deed, your lawyer will accompany you to the Notary (Notario) to assist you. Lawyer’s fees may vary. Some charging a percentage of the purchase price and whilst others charge a fixed rate. When buying a property in Spain it is advisable to use a Spanish/English real estate lawyer who is located in the province that you are buying. Buying a property in Spain When you have found your ideal property in Spain what is the next step? A holding deposit will be required payable to the agent or lawyer. This can be a smaller reservation fee of 3000€ or 10% of the purchase price. At this stage a contract will be provided indicating when the completion will take place. The lawyer you appoint can check over the contract and advise you if any changes need to be made. Completion dates can vary depending on the circumstances but generally between 3 weeks and 3 months. Certain costs and taxes are incurred when purchasing a property in Spain, adding between 10 and 12% on top of the purchase price should be ample to cover all the costs incurred. |
